Maybank2u.com Bills & Statements Terms of Use Agreement (the "Terms of Use").

The Maybank2u.com My Statements/My Bills Service (the "Service" or the "My Statements/My Bills Service") is provided by Malayan Banking Berhad ("Maybank", "we" and "us") under Maybank2u.com. These Terms of Use describe the terms and conditions for any use of the Service. You shall signify your agreement to the terms and conditions contained herein and accept responsibility for your use of the Service by clicking on the "Accept" button appearing at the end of these Terms of Use. You should read these Terms of Use carefully before you click the "Accept" button and accept them. If you click the "Cancel" button, you will not be enrolled in the Service.

Please note that usage of the Service is subject to all applicable laws and regulations and that these Terms of Use are to be read together with the terms and condition of the Maybank2u.com Internet Banking Services and the Maybank2u.com Terms and Conditions of Access. Unauthorised access and use of the Service is strictly forbidden.

Definitions

(a) For the purpose of these Terms of Use, the following terms shall, unless the context otherwise requires, have the meanings as defined below. All other terms not defined herein shall have the meaning as may be defined in the Terms and Conditions of the Maybank2u.com Internet Banking Services or where no definition has been provided, the said term shall have the meaning as may generally be accepted within the industry based on the context used herein.

(i) "Account" means your savings, current, credit card, loan, investment, fixed deposit, share trading or any other accounts which you may have with the Bank which may be accessed via Maybank2u.com;

(ii) "Bank" means Malayan Banking Berhad and includes its subsidiaries and other companies within the Maybank Group, its successors in titles and assigns, and where applicable, any of them;

(iii) "Bill" means the latest applicable bill, renewal notice, advice and/or payment demand of selected Billers, which has been registered via the Service (and activated by Maybank), in accordance with the terms herein;

(iv) "Biller" means the payee corporations/billing corporations or other relevant corporations approved by Maybank from time to time, whose Bills can be viewed, saved and printed by you via the Service in the form of My Bills as well as paid by you using the Maybank2u.com Internet Banking Services.

(v) "Maybank Group" refers to the companies within the Maybank group of companies, which are existing now or in the future, owning or owned by under common ownership either directly or indirectly or controlling, controlled by or under common control with Malayan Banking Berhad;

(vi) "My Statements/My Bills" refers to electronic statements of or in relation to Accounts and Bills as more particularly defined in Clause 2 (b) herein; and

(vii) "Security Access" refers to such confidential authentication information required for your access to and use of Maybank2u.com Internet Banking, whether in the form of words, codes, numbers, sets of characters or such other form or combination thereof, as may be prescribed by Maybank from time to time.

Description of Service

(a) The My Statements/My Bills Service is provided by Maybank via Maybank2u.com and allows customers of the Bank that have subscribed to the Maybank2u.com Internet Banking Service to view, save and print in PDF format or such other format as may be made available by Maybank from time to time, the My Statements/My Bills of the customer's Accounts and Bills subject to the terms herein.

(b) My Statements/My Bills are an electronic version of the paper statements, notices, advice or reminders mailed or otherwise provided to the Bank's customers by the Bank or by the relevant Biller that are made available via the Service in a form either identical in full or in part, to the paper version of the said statements, notices, advice or reminders, and/or in a summary form (as applicable).

(c) Notwithstanding (b) above, you acknowledge that the Bank will not provide My Statements in the form of Account statements to customers who are not previously entitled to the paper statements of the same under the applicable rules of the said Account, although My Statements in the form of notices, advice and reminders may still be provided in relation to the said Account, at the Bank's discretion.

(d) Maybank reserves the right to modify, add to, or remove any feature of the Service at its sole discretion from time to time with or without notice.

How to enrol for the Service

You must first be a Maybank2u.com Internet Banking customer before you can use the Service. To have access to the Service, you must enroll at the Maybank2u.com web site and accept these Terms of Use.

To enroll, kindly follow these steps:

(a) Login to Maybank2u.com Internet Banking.

(b) Select My Statements/My Bills.

(c) A page will appear with the Terms of Use.

(d) If you accept the terms and conditions of the Terms of Use, Click "Accept".

(e) You are ready to use the My Statements/My Bills Service.

Accessing My Statements/My Bills

(a) My Statements/My Bills of Accounts and Bills will be provided to you periodically in accordance with its applicable statement cycle (if any) or from time to time at the Bank's discretion, via the Service when you connect to Maybank2u.com Internet Banking.

(b) Prior to your access and view of My Bills however, you are required to register the particular Bill via the Service. My Bills are available only in relation to registered Bills that are confirmed by Maybank as being "Activated".

(c) The process for registration and activation of a Bill via the Service is as follows:

(i) Go to the Bill Registration page under Maybank2u.com

(ii) Select the relevant Biller from the drop down list provided on the said page

(iii) Enter the particular information needed to register a particular Bill

(iv) After successful registration, the system will check whether the Biller is a participant in the Service and if so, a statement will appear to allow customers the option to proceed to register the Bill under the Service. (This option shall not be available for Billers who are not current participants of the Service)

(v) Click the necessary links to go to the Biller Registration page where all Bills submitted for registration under the Service will be listed

(vi) Proceed to register the applicable Bills listed in accordance with the procedure therein

(vii) After each successful registration, an Activation request will be sent to the relevant Biller

(viii) Confirmation will be provided as to whether the Activation is successful or has been rejected in the Biller registration status as indicated in your My Bills summary page under Maybank2u.com

(d) In registering Bill(s) under the Service you:

(i) expressly consent to the relevant Biller providing or making available to Maybank the Bill(s) and the details and information therein;

(ii) expressly consent to Maybank's utilisation of the details and information of the Bill(s) in the provision of the Service and to the same being accessible by the Bank and its affiliates and sub-contractors who are involved in the provision of the Service;

(iii) undertake that you have all necessary rights and consents to access and view the Bill(s) and all details therein and where applicable make payment in relation thereto;

(iv) undertake that you have all necessary rights and authorisations to provide the consents stipulated in (i) and (ii) above.

(e) You acknowledge that confirmation of the successful or non-successful activation of a Bill will only be provided by Maybank upon Maybank's receipt of a response from the relevant Biller in relation to such Bill registration. Where no response is received from the relevant Biller, the status of the registration will remain as ‘pending' until such time as the same is removed by the system from your My Bills summary page in which event you will need to, if you wish to proceed, repeat the process for registration of the relevant Bill as stipulated in (c) above. In no circumstance will Maybank be liable for any delay or failure in the provision of confirmation of the successful or unsuccessful activation, or as the case may be, of the deregistration of a Bill.

(f) In any event, you acknowledge that activation of a Bill will ultimately be at Maybank's sole discretion and Maybank shall be entitled to reject a registered Bill under the Service without liability and without obligation to provide reasons for such decision.

(g) In the event that you no longer wish to access and view the My Bills in relation to an activated Bill, you may deregister the Bill in accordance with the procedure for deregistration under Maybank2u.com. My Bills in relation to such Bill will cease to be available for access and view upon confirmation of such deregistration being provided to you by Maybank.

(h) You acknowledge that any payments made by you based on the My Statements/My Bills will be made under Maybank2u.com and are subject to (inter alia) the Terms and Conditions of Maybank2u.com Internet Banking Service.

(i) Under the Service you will be able to view, save and/or print My Statements/My Bills up to a prescribed period which, unless otherwise specified by the Bank, will depend on the applicable statement cycle (if any) as available at www.maybank2u.com.my. For example, if the statement cycle is on a daily basis, My Statements/My Bills may be available for up to thirty (30) days prior thereto or where the statement cycle is on a monthly basis, My Statements/My Bills may be available for the current month and the previous two (2) months that you have been enrolled in the Service. Availability of My Statements/My Bills in the form of notices, advice, reminders or any other forms of My Statements/My Bills with no fixed cycle however will be for such period as may be at stipulated by the Bank from time to time.

(j) You will need Adobe Acrobat Reader v. 7.0 or the then current version of the same in order to view, print, and/or save your My Statements/My Bills in PDF format.

Third Party Bills

(a)You are not allowed to register the Bill of a third party under the Service.

Accuracy and Timeliness of My Statements/My Bills

(a) You acknowledge and understand that certain information and data in the My Statements/My Bills are based on information and data provided by third parties from time to time, i.e. from other companies within the Maybank Group in relation to any customer Accounts as may be managed and operated by them (as applicable) as well as from Biller in relation to their Bills. You further acknowledge and understand that the My Statements/My Bills are prepared by electronic means and the information contained therein is extracted from computerised systems maintained by the Bank, its affiliates or the Billers. As such, although Maybank endeavours to provide My Statements/My Bills with accurate and up to date content, it does not warrant the same. Maybank shall not be liable for any such error, omission or discrepancy in the My Statements/My Bills and you hereby agree to hold Maybank harmless against any losses or damages as may be incurred or suffered by you in relation to any such error, omission or discrepancy.

(b) You acknowledge that you shall be responsible to verify the accuracy and timeliness of all information and details in the My Statement/My Bills upon your accessing and viewing the same. In the event that you discover any error, omission or discrepancy in the said My Statements/My Bills you shall notify Maybank in accordance with the procedure as laid out in Clause 15.

Paper Statements

(a) You acknowledge that upon your enrolment to the Service and unless expressly stipulated by Maybank or unless alternative arrangements has been made with Maybank in accordance with (c) below, My Statements of your Accounts shall replace paper statements, notices, advise and reminders previously mailed or otherwise provided to you by Maybank.

(b) Maybank shall in relation to such Accounts cease to provide you with hard copies of its statements, notices, advice and reminders for as long as you are enrolled in the Service. The foregoing however shall not apply to the service or delivery of demands, notices or other documents which are required to be served prior to commencing legal proceedings.

(c) In the event that you nevertheless wish to continue to receive paper statements, notices, advice and reminders in relation to those selected Accounts from Maybank, please contact Maybank at the contact details stipulated in Clause 15 and submit a formal request for the same. You acknowledge that Maybank shall have the right to impose charges in relation to such paper statements, notices, advice and reminders.

(d) For the avoidance of doubt and unless otherwise expressly stipulated by Maybank, the foregoing shall not apply to paper statements, notices and reminders in relation to Accounts managed and operated by other companies within the Maybank Group or in relation to Bills of Billers, whereby issuance of hard copies of such statements is at the discretion of such parties and is based on your arrangement with them.

Service Charges

Maybank reserve the right to impose a fee for the Service at its discretion at any time upon giving notice to you.

Security and Equipment

(a) Information you provide in connection with the Service will be stored on Maybank2u.com's secure servers and protected by certain encryption techniques. However, the security of the Service depends upon your efforts to protect your Maybank2u Security Access for the Service. You must take all necessary precautions to safeguard your Maybank2u Security Access, which allows you to access the Service.

(b) You shall be responsible for all access and use of the Service via your Maybank2u Security Access whether authorised by you or otherwise and shall indemnify Maybank in relation to any liability, losses or damages suffered or incurred by the Bank arising from the access and use of the Service via your Maybank2u Security Access.

(c) You also have the responsibility to provide any equipment (telephone, computer, etc), software, and services necessary to use the Service.

Maybank2u.com's Proprietary and Intellectual Property Rights

Other than information related to your Account(s) and Bill(s), all content available on the Service (including its arrangement) is the property of Maybank or the relevant Biller or third parties and is protected by copyrights, trademarks, or other intellectual and proprietary rights. Your usage of the Service does not grant you a license or right to use any Maybank2u.com trademark without the express written approval of Maybank. In addition, your usage of the Service does not grant you a license or right to use any third party trademark without the express written approval of the third party possessing rights to such trademark.

Change in Terms of Use and Termination

(a) Maybank has the right to amend these Terms of Use at any time and from time to time. Any amendments to these Terms of Use will be effective when they are posted on www.maybank2u.com.my. You are responsible for checking www.maybank2u.com.my periodically for any such amendments.

(b) If at any time you do not agree to the Terms of Use and any amendments made thereto, you may cease use of the Service by deregistering all Bills currently registered and activated under the Service. Your continued use of the Service will be deemed as your acceptance of the Terms of Use and its amendments thereto. enrol

(c) Notwithstanding anything herein, you agree that Maybank shall have the right to suspend, withdraw or terminate at anytime and without notice the Service or any part thereof in relation to all or any of your Accounts or registered Bills, due to your breach of these Terms of Use or for any reason without assigning any reason therefor.

(d) These Terms of Use will be effective beginning the date you enroll for the Service until cessation or termination of the Service either by you or by Maybank pursuant to the terms and conditions herein.

Limitation of Liability

(a) Neither Maybank nor any third parties represent or warrant that you will have continuous or uninterrupted access to the Service, or that any of the functions of the Service will be error-free. The Service is provided to you "as is" and "as available", and Maybank and its service providers make no representation or warranty relating to the Service, including, without limitation, its performance, availability, content, or functions.

(b) In addition to any other disclaimers and exclusions as may be stipulated in the Maybank2u.com Terms and Conditions of Access and Maybank2u.com Terms and Conditions of Internet Banking Services, and to the extent as may be permitted under law, Maybank disclaims all warranties, conditions, guarantees, representations, express or implied with respect to the Service.

(c) In no event will the Bank or its officers, directors, employees, shareholders, affiliates, agents, licensors, or third party service providers be liable in contract, tort (including negligence) or otherwise for any loss or damage (including but not limited to consequential, incidental, special or punitive damages) sustained by you or any other party arising directly or indirectly from your access or use of the Service including but not limited to loss or damage arising from:

(i) any defect, delays, interruptions or failures in the provision of the Service;

(ii) any inaccuracies, or errors in any data or information in your My Statements/My Bills or otherwise provided or made available via the Service;

(iii) the failure to view, save, print or download your My Statements/My Bills due to limitations of the Service or any failure of the Service or any part thereof for any reason;

(iv) the corruption, loss of or error in any data or information provided by Billers or other party other than Maybank for incorporation in your My Statements/My Bills for any reason;

(v) any unauthorised use of the Service and/or intrusion, interference or attack on Maybank2u.com or your Service by any person, virus, Trojan Horse, worm, macro or other harmful components or deleterious programs or files;

(vi) your failure, neglect or omission to act in accordance with the terms and conditions of this Terms of Use and any other laws, rules, regulations, policies and guidelines currently in force;

(vii) an event which is beyond the reasonable control of Maybank;

(viii) Maybank performing and exercising its rights, obligations and discretion pursuant to this Terms of Use; and/or

(ix) the act or omission of any party other than Maybank.

 

(d) Your sole remedy for any failure or non-performance of the Service shall be for us to use commercially reasonable efforts to perform an adjustment or repair of the Service and if you remain dissatisfied with the Service, to discontinue your access and use of the same.

(e) The foregoing clauses shall apply to the fullest extent as permitted in law.

Indemnification

Further to any other provisions herein, you hereby agree to indemnify and keep Maybank indemnified from and against any and all claims, losses, liabilities, cost and expenses (including but not limited to any legal fees) arising directly or indirectly or which may arise out of your breach or violation of these Terms of Use or any third party rights or your use or purported use of the Service.

Evidence and Use of My Statements/My Bills

(a) You acknowledge and agree that in the absence of a manifest error, all evidence of communications transmitted between you and Maybank, including the My Statements/My Bills and any evidence in the form of, among others, computer printouts, transaction logs, and any other form of information and data storage, shall be binding on you and treated as conclusive evidence of your instructions, transactions and the communications between you and Maybank, for all purposes.

(b) Notwithstanding the above, you agree that use of printed My Statements/My Bills for any purpose other than for your own personal record, including without limitation as supporting documentation for the purpose of any applications or registrations with any bodies or corporations or for the purpose of making payments of any fee or charge due and owing to a party other than to Maybank or the relevant Biller, shall be entirely your responsibility and at your own risk. Maybank does not warrant that the My Statements/My Bills shall be sufficient for any other purpose or that it shall fulfil the requirements of any other bodies or corporations.

Queries and Complaints

(a) In the event that you have any queries, complaints and/or disputes arising from your access to and use of the Service, you shall refer the matter to Maybank as per the relevant contact details as stipulated in the Maybank2u.com website.

(b) Maybank shall use its reasonable endeavours to respond to the queries and resolve any problems or issues as may be raised by you.

(c) You shall specify the nature of your query, complaint and/or dispute and such other details or information as may be required by Maybank and such complaint and/or dispute shall be handled and/or resolved in accordance with Maybank's internal complaints and dispute resolution procedure.

(d) Where the query, complaint and/or disputes are the results of errors, acts or omissions of the Biller, the matter shall be escalated to the relevant Biller in which event all such queries, complaints and disputes are to be settled between the Biller and you. Maybank's role in relation thereto shall be limited to the provision of relevant information only.

Changes to procedures and processes or branding

You acknowledge that to (inter alia) ensure the smooth and efficient provision of the Services and/or to improve the Services, Maybank shall have the right and discretion to make such amendments and modifications as it deems necessary to (i) the procedures and processes applicable to the Services (i.e. procedure for acceptance of Terms of Use, registration and activation of Bills, etc); and (ii) the trade or service names used in relation to the Services (i.e. My Statements, My Bills, etc) as referred to in these Terms of Use. Notwithstanding the same, you hereby agree that pending actual changes being effected to these Terms of Use, the said Terms of Use shall nevertheless continue to be applicable to the Services whereby the amended or modified procedures and processes and/or new trade or services names shall be deemed to replace the previous procedures and processes and/or new trade or services names, accordingly.

Severability

In the event any portion of these Terms of Use is found to be unlawful or illegal or unenforceable, such portion shall be excluded from these Terms of Use, and such exclusion shall not affect the enforceability, legality and lawfulness of these Terms of Use in any way and the remaining terms shall be separately enforced to the maximum extent permissible so as to effect the intent stated in these Terms of Use.

Waiver

In the event that Maybank fails to or neglects to enforce any terms, provisions or remedies under these Terms of Use or otherwise in relation to the Service for whatever reason, Maybank shall neither be construed as having waived its rights to any preceding, continuing or subsequent breach of the same or any other provisions stated in these Terms of Use.

Laws and Jurisdiction

(a) The Service provided herein is governed by the laws of Malaysia and you hereby consent and submit to the exclusive jurisdiction and venue of the courts in Malaysia in all disputes arising out of or relating to the use of the Service.

(b) Use of the Service is unauthorised in any jurisdiction that does not give effect to all provisions of these Terms of Use and/or the Maybank2u.com Terms and Conditions of Access.
